Purpose of this study grasps problem of North Korea law connected with inter-Korean economic cooperation through examination of structural order and main contents of North Korea's foreign economy legislations, it is that grope confrontation plan that South Korea government can adopt actually.
North Korea's foreign economy legislation is retaining following problems.
ⅰ) It is impossible access for the legal specific contents. ⅱ) Concreteness of the provision is defective. ⅲ) Security of effectiveness about observance of international rule is insufficient regarding dispute resolution. ⅳ) Most of them stress the part of domestic. ⅴ) The informations can verify legal application examples are lacking. ⅵ) There is no specific reference about Enterprise of South Korea.
Therefore, our government will have to urge to establish special legislation that can apply specially to inter-Korean economic cooperation to the North Korea. On the other hand, we press them for a conclusion of South-North trade agreement that have property as international trade agreement.
It is necessary that companies receive legal protections whom North Korea acknowledge at least as it is stipulated in writing that North Korean foreign investment laws and foreign economy laws are universally applicable including South Korean companies before coming to this arrangements. In addition, make an effort to decrease business risk by inserting related provisions which can be investment protect insert a sentence in the contract, for example, force majeure provision and method of dispute settlement in the contract cleary.
