This paper compares the unilateral trade measures of the U.S.A.'s 301 and EU's TBR, and examines how they can affect Korea. In general, the 301 and the TBR Regulation are applied to both goods and trans-frontier services, which do not involve labour movements. In the case of Korea, three TBR examination procedures are applicable to, for example, cosmetics, pharmaceuticals, and shipbuilding industries, while the 301 is applied to the industries of automotive, insurance, and IPR. In this study, we argue that the 301 and the TBR are the unilateral trade measures and trade policy instruments. But, they are offensive rather than defensive.
The U.S. and EU often use the unilateral trade measures in order to enjoy an advantage in a bilateral negotiation. In other words, the U.S. not only utilize multilateral and bilateral pressures as trade measures for its own interest, but also use all unilateral trade measures under the legitimacy of the US. trade law, such as the Super 301 clause. So, the country mainly have its focus in achieving its aim in negotiation rather than the justification of the means. EU also applies the TBR to protect domestic industries and to let its trade partners open their domestic markets.
In this relation, Korea should understand how much the country's trade system and policy are well coincided with international trade rules rather than try to avoid currently rising trade pressures with an ad hoc measure. If there is any trade conflict with the USA and EU, Korea needs to take the issue to the WTO dispute settlement procedure, unless an amicable solution is agreed through a negotiation.
Also, the country needs to take positive and legitimate trade policy, FT A, and industrial cooperations with the U.S. and EU, in order to strengthen harmonious trade cooperations. If the Korea-U.S. FTA and the Korea-EU FTA under negotiation are made, the U.S. and EU will reduce their unilateral trade measures against Korea.
