The current situation of the Graphic User Interface (GUI) related design protection in China is introduced herein. The current characters of GUI related design protection in America, EU and Japan are introduced firstly. The background for the development of GUI related design protection in China is analyzed, and then the regulations on protectable subject matters of the GUI related design under the currently enforced Patent Law are emphasized and illustrated with examples. By analyzing the differences among some countries, suggestions are provided regarding how to file GUI related design applications in China and consideration for the development and enforcement of GUI related design protection in China is proposed.
