Indeed, it is essential to establish a conceptual and philosophical foundation regarding the topic of ‘legal person(-hood)’ in legal philosophy, but actually little attention has been paid to it for a long time. In recent years, however, we witness increasingly more and hotter debates in the Western legal academics over the topic of ‘legal person’ in law. Two backround facts are available for this trend. First, while the non-human natural beings such as fetuses, animals, and the nature itself have traditionally not been recognized as legal persons, for the past decades lots of efforts have been made to change this tradition. Second, the recent technological innovation has triggered new controversies over the legal personhood of non-human artificial entities such as artificial intelligence as well.
Meanwhile, several notable works on the topic have emerged. (i) Ngaire Naffine, Law’s Meaning of Life: Philosophy, Religion, Darwin and the Legal Person (Hart Publishing, Oxford, UK, 2009), (ii) Visa A. J. Kurki & Tomasz Pietrzykowski (ed.), Legal Personhood: Animals, Artificial Intelligence and the Unborn (Springer International Publishing, 2017), and (iii) Visa A. J. Kurki, A Theory of Legal Personhood (Oxford University Press, 2019).
In this paper, I review these books in turn. Book (i) shows that persons and legal persons appear and play a role on their own in various senses and contexts in law. Book (ii) is a collection of papers that show that there are good reasons for ‘legal person’ to apply beyond natural persons to non-human beings such as animals. Book (iii) attempts to provide a new theory of legal person from a legalistic perspective. It attempts to separate ‘legal person’ from ‘rights’ or ‘capacity for rights’ and classify the former category into several subcategories in a sophisticated manner.
In these books different perspectives of legal personhood point to different significant fundamental points of discussion, and each of the perspectives occupies a singularity as such. Today, the theory of legal personhood consists of the viewpoints from various intellectual sources, which open up a rich discussion on the fundamental subject in legal philosophy―although there remain lots of fundamental challenges for the discussion.
