The year 2003 will be a monumental year in the history of Korean local autonomy. With the emergence of Noh Moo-hyon government stressing decentralization the new government's national policy has become centered around the issue of decentralization. Those bills aimed to implement decentralization and balanced regional development passed the Assembly on December 29, 2003 with much difficulty. The newly enacted legislation included the Special Act on Decentralization, Special Act on Balanced National Development, Special Act on the Construction of the New Capital and the Law Governing Referendum. Decentralization movement will continue with enthusiasm, though there will remain a question as to the dynamic and intensity of such a movement.
However, it is hard to tell whether a local assembly has faithfully played its roles in the course of discussing decentralization, as the local assembly, an institution representing the residents, is supposed to play a key role.
Although questions were actively raised for discussion at the local assembly when those bills for the above-stated special laws were drafted, it is difficult to say that the local assembly is now leading the main stream of decentralization.
This study examined the ideal roles of a local assembly when seen from the legislative and institutional point of view, particularly the roles of a local assembly as a representative body of residents, as the authorities speaking for the will of the people or as an assembly appropriate for the age of decentralization, and presented a solution to relieving the problems relating to such roles.
For the purpose this study discussed a revision of the Law Concerning Local Autonomy to include the scope of authority to be delegated, strengthening legislative power of the local autonomy, a need for discussing the adoption of a pay system for the members of the local assembly, delegating the right of personnel management, reforming the operation of the assembly and the reformation of the election system such as cancelling the system of being elected without voting. It also reviewed the reformation of the Japanese parliamentary system for the decentralization, which was made in recent years.
