Korea has enacted various special criminal acts in order to cope with social change. Some special criminal acts have provisions to conflict with the criminal jurisprudence, and have the contradiction and unbalance among penal provisions. We showed some legal ways to resolve these problems under current legal systems and improve special criminal acts.
First, we focused on the environment sector. Current criminal act have no provision to regulate environmental crime directly. The 「Act on Special Measures for the Control of Environmental Offenses」 (ⅰ) has a narrow coverage, (ⅱ) has even severe punishments than other general environmental laws and (ⅲ) has no provision on the punishment of the person who is guilty of attempt. The general environmental laws (ⅰ) have some provisions of excessive punishment, (ⅱ) have some penalty provisions whose composition conditions are unclear, (ⅲ) put different court punishments to the similar composition conditions.
To deal with the environment crime effectively, we should put a general provision for the environment crime in the Criminal Act. Some of penal provisions in the general environmental laws should be converted into the fine for default.
Then, we focused on the traffic sector. Many traffic order offenses are treated as crimes, and are punished excessively. The legal ways to resolve these problems include: (ⅰ) The negligible traffic order offenses should be decriminalized; (ⅱ) Traffic crimes under the Criminal Act should include traffic crimes related to ship, aircraft, and so on; (ⅲ) the Criminal Act should add an illegal use of a car in the crime of theft, or create dangerous driving crime; (ⅳ) In the 「Act on Special Cases concerning the Settlement of Traffic Accidents」, the restorative justice should be incorporated and article 4 should be rescinded.
