The ICC's 1992 Uniform Rules for Demand Guarantees ("URDG 458") are intended to apply to demand guarantees that legally share the identical independent nature and the documentary character with letters of credit including standby credits. In cooperation with the Commission on Commercial Law and Practice, the Commission on Banking Technique and Practice of ICC is now revising the URDG 458, which is expected to be published as ICC Publication no. 758 in near future, possibly in 2010.
This paper introduces and overviews those works focusing on current revised URDG draft, the third draft, which is more detailed and upgraded than URDG 458. While the revision is founded on more than 15 years experiences of demand guarantee practices, the drafts are substantially influenced much by the Uniform Customs and Practice for Documentary Credits, 2007 Revision ("UCP600") and, to some extent, the International Standby Practices ("ISP98") as well. The revised URDG draft, for examples. accepts the preclusion rule, the rules on process of issuance of the notice of rejection, and the treatment of non-documentary conditions etc., which bring the UCP and the URDG closer than ever before; Regarding transfer of guarantees, the rules of UCP600 and ISP98 on transfer have provided meaningful inspiration to new provisions on transfers in the revised URDG draft.
All this changes seem to aim at achieving a better practice of demand guarantees under a more comprehensive set of rules.
