Panel and Appellate Body of WT/DS430 and WT/DS447 made several specific interpretations regarding Article 6 which establishes the obligation to adapt the SPS measures to SPS characteristics of an area. They analyzed the meaning of the obligations contained in Article 6.1, 6.2 and 6.3, and the relationships between obligations contained in the three paragraphs of Article 6.
Frist, Article 6.1 establishes the main and overarching obligation for a Member to ensure that its SPS measures are adapted to SPS characteristics of an area. Pest or disease free and low pest or disease prevalence under Article 6.2 is one part of SPS characteristics, by this reason, in some circumstances a panel assessing whether a Member has complied with the obligation of Article 6.1 may not need to assess whether that Member has previously complied with the obligation of Article 6.2.
Second, The obligations in Article 6.1 and 6,2 are not triggered by the actions of the exporting Member under Article 6.3. However, in some circumstances the ability of the importing Member to implement the obligations under Article 6.1 is dependent on the exporting Member’s compliance with Article 6.3. Because without exporting Member’s cooperation, for importing Member the determination of the pest or disease status of the areas concerned may impossible.
Third, there is possibility that whereby the importing Member does not enough information to conduct a risk assessment for determining the pest or disease status of the areas concerned. In such circumstance, if the three cumulative requirements of Article 5.7 are satisfied, then the SPS measures of importing Member would fall within the scope of Article 5.7.
