Constitutional Court of Korea considered that Night outdoor assembly regulations, clause 10, the law on assembly and demonstration and ‘outdoor assembly in the text of clause 10’, article 1, clause 10, of the foresaid Law were unconstitutional since they breached the prohibition regulation to prohibition of permit system, article 21, clause 2 of the constitutional law, therefore, made a decision of disagreement to the constitutional law on September 24, 2009. First, the viewpoint of Constitutional Court of Korea that clause 10 and number 1, clause 23 in the law on assembly and demonstration breached the prohibition regulation to prohibition of permit system in article 2, clause 21 of the constitutional law is valid. That is, it is defined that "…the Head of the police station may permit outdoor assembly before sunrise or after sunset with the condition to maintain order.", the proviso in clause 10 in the law on assembly and demonstration but the Head of the police station makes night outdoor assembly not opened at discretion due to the regulation of "…the Head of the police station… may permit.", even if the promoter of assembly reported with the condition defined in the law on assembly and demonstration arranging order maintenance people in advance. Hence, clause 10 and number 1, clause 23 in the law on assembly and demonstration breached the prohibition regulation to prohibition of permit system, article 2, clause 21, the constitutional law and they were unconstitutional. However, if Constitutional Court of Korea declares only that clause 10 and number 1, clause 23 in the law on assembly and demonstration breached article 2, clause 21 of the constitutional law, it is not valid since the problem below occurs. That is, if National Assembly cancelled the proviso in clause 10 in the law on assembly and demonstration in the future, the permission of assembly cannot be decided at discretion of the Head of the police station so it does not breach the regulation of the prohibition regulation to prohibition of permit system, article 2, clause 21, the constitutional law. However, night outdoor assembly is prohibited generally and totally by the text in clause 10 in the law on assembly and demonstration only by abstract judgment that night outdoor assembly would be detrimental to public peace and order by being violated easily that day outdoor assembly, which cannot be proved, is neither valid in the purpose of legislation, reflecting it on the principle of proportion, nor appropriate to the means. The interception of danger to damage public order or the benefit and protection of the law for other people due to the opening of night outdoor assembly should be made not by the means of the prohibition of night outdoor assembly, in principle, by clause 10 in the law on assembly and demonstration but by clause 2, 4, 5, 6, 8, 11, 12, 13, 14 and 20 in the law on assembly and demonstration. And, assembly is prohibited in extensive time such as ‘before sunrise and after sunset’, not prohibiting assembly after eleven o’clock at night in France or Russia, so it breaches the principle of minimum infringement. In addition, private benefit, infringed by being incapacitated of freedom of assembly, would be larger than public peace and order acquired by the prohibition of outdoor assembly at night by clause 10 in the law on assembly and demonstration. Therefore, it would be desirable that Constitutional Court declared that the text in clause 10 in the law on assembly and demonstration breached article 2, clause 37 of constitutional law as well as breaching article 2, clause 21 of constitutional law in this decision. Furthermore, it would be desirable that Constitutional Court declared simple unconstitutionality to clause 10 and number 1, clause 23 in the law on assembly and demonstration than decision of disagreement to constitutional law and abrogated the foresaid regulations in the law on assembly and demonstration to secure freedom of assembly as much as possible.
