【Abstract】 A Legal Issue on the Electronic Payment Gateway Kim, Hong-Sik Nowadays the size of Electronic Financial Market has developed with assistance of internet and information technology. As the market grows, the problem related with enlargement also is occurred. So our government come to figure out this problem and try to pass new legislation about electronic financial transaction. Hence Electronic Financial Transaction Act[EFTA] came into force on 2007.1.1. When people buy something in On-line shopping site through the internet, a lot of people use credit card as payment. But few people know Payment Gateway Service Provider is behind the electronic transaction. Electronic Payment Gateway is a Service that carry out payment order of customer to be completed. Usually Electronic Payment Gateway Service Provider[PG] had a contract with On-Line shopping site that are too small to carry payment solution. Following that contract PG provide payment solution with security and do a business for On-Line shopping site with commission. PG become a Electronic Financial Service Provider through register of EFTA. Here some legal issues will be discusses in relation with PG as the Electronic Financial Service Provider. First of all duty and responsibility of PG as the Electronic Financial Service Provider under EFTA and Credit Financial Service Provider Act will be focused. Conflict of EFTA and Credit Financial Service Provider Act related with legal position of PG is important matter to discuss. After theory and regulation of United State of America are reviewed, data-privacy and consumer-protection are also discussed in connection with PG from the point of comparative law.
