As it is widely known, the Major Accidents Punishment Act was enacted under the influence of the UK"s 2007 Corporate Manslaughter and Corporate Homicide Act. However, the law of Korea is quite different from that of the UK. Unlike the British law, the main targets are not corporations, but individual business owners and business officers(managers), emphasizing their obligations to secure health and safety.
In addition, the Major Accidents Punishment Act, unlike the Occupational Health and Safety Act, imposes fairly comprehensive duties on business officers and plans severe punishment for violations of duties. After legislation, it will be an important task to interpret and implement the duties of the person in charge of management in accordance with the purpose of the legislation.
This article shows an interpretation model on main issues focusing on the business officers’ management duties to secure workers’ health and safety which is the core of the Law.
