Over the past 50 years, discussions have consistently revolved around strategies to protect the wages of taxi workers. Initially, the wage structure for taxi workers was based on a “piece-rate wage system.” This system created instability in the lives of taxi workers, fostered intense competition among them, and was identified as a leading cause ofincreased traffic accident rates.
Efforts to protect the wages of taxi workers were made in response to these circumstances. However, these discussions did not yield concrete results. To safeguard the livelihoods of taxi workers, the government and local authorities proposed the introduction of a “full monthly salary system.” This system was legislated in August 1994 and implemented from September 1997. However, there was no legal basis to compel taxi business owners to adopt this system. Taxi business owners cited operational difficulties and their inability to effectively manage the attendance of taxi workers as reasons to avoid implementing the “full monthly salary system.” Consequently, the establishment of this system has faced prolonged challenges.
Efforts towards the substantial implementation of the “full monthly salary system” have persisted. Amendments to the “Minimum Wage Act” excluded “wages based on productivity” for taxi workers from the scope of the minimum wage. Modifications to the “Passenger Automobile Act” provided a specific legal basis for the implementation of the “full monthly salary system.”
Courts have also played a role in supporting the “full monthly salary system.” The Supreme Court"s Grand Bench declared that any agreement that shortens regular working hours without altering actual working hours is null and void as it violates mandatory regulations. The Constitutional Court ruled that the special provision excluding “wages based on productivity” for taxi workers from the minimum wage range is constitutionally sound. However, debates surrounding the “full monthly salary system” persist.
Therefore, this paper discusses strategies for the smooth implementation of the “full monthly salary system.” It begins by emphasizing the necessity of protecting taxi workers" wages in the form of a monthly salary. Subsequently, it delves into the historical context to understand the efforts made and the reasons for repeated failures in implementing this system. Finally, it outlines the direction for the implementation of the “full monthly salary system” for taxi workers.
