sports. These disputes occur across all sectors, including school sports (involving student athletes), professional sports, recreational sports, and sports for individuals with disabilities. The issue is that South Korea currently lacks a well-established policy system for addressing sports disputes. Given the increasing need for qualitative development to support the broader growth of the sports industry in the country, research on policies for resolving sports disputes has become even more crucial. The primary objective of this study is to explore possible solutions for resolving sports disputes through a systematic literature review, focusing on the parties involved, existing dispute resolution proposals, and current resolution mechanisms, in order to propose practical solutions.
The key findings are summarized as follows: First, Sports disputes can be categorized into conflicts involving individuals, organizations, national team athletes, and other types. Second, methods for resolving sports disputes include informal mediation and agreements between the parties involved, formal mediation and agreements facilitated by national institutions or sports organizations, and litigation. Lastly, As a suitable solution for addressing sports disputes within the South Korean context, the study proposes the establishment and operation of a "Sports Dispute Arbitration" system.
In conclusion, sports disputes cannot be effectively resolved through individual agreements or dialogue alone. It is now urgent to establish and implement policy-based mechanisms for resolution. This study aims to serve as a foundational step toward that goal.
