The feature of modem country is recognition of freedom and property as fundamental rights. At the outset, property right was permitted only to tangible goods, but as intellectual creation enriching society has increased, the idea of protection about intangible and intellectual assets emerged. Basically, intellectual property is a conception born in the society where property right is granted and then, it is difficult one to be granted in a communist country that does not recognize private property right. Accordingly, it can be assumed that intellectual property in communist countries may be different from that in capitalist countries.
The most traditional function of trademark is to distinguish trademark owner's goods or services from others. In contrast to other intellectual property rights such as copyright and patent, trademark has the least characteristic as property. Mostly, an owner simply chooses a trademark among existing symbols and less creativity is involved in trademark. Especially, in modem society, advertising function of a trademark becomes more crucial than the function as a source indicator.
The USSR and China, former communist countries, had intellectual property systems including trademark. The trademark in USSR and China performed a conventional function as an indicator of source. Moreover, trademark was a tool for government to control manufacturers, and under planned economy, there was no advertising function of trademark in USSR and China. In the late 1980s, USSR collapsed and Russian Federation was established. China did not suffer such a dramatic change as USSR, but it started to introduce market economy. Recently, both of them try to expand international trade and to increase foreign investigation. To accomplish these purposes, they amended intellectual property law including trademark law and strengthened its protection. Even though elements of communist systems still exist, their continuing efforts will fix these problems promptly.
