A trademark is composed of any word, name or symbol or any combination thereof. A owner of trademark may have exclusive control over them. In past, the exclusive right is limited to goods and services used or registered by the owner. However, with protection of dilution, the trademark owner may expand the exclusivity of a trademark beyond registered or used goods and services. Dilution gives a trademark owner property-like right. A owner can prohibit use of the mark by a third party without 1ikelihood of confusion. As the extent of exclusive right is expanded by protection of di1ution, freedom of speech is shrunk. As to non-com mercial speech, the use of a word or symbol in a trademark may not be considered as use of a mark because such use is not related with commercial transaction and there is no likelihood of confusion of the source. However it is not always clear from dilution whether non-commercial use of a mark is not trademark infringement. Non-commercial use will be at least tarnishment of a trademark. As to commercia1 speech, there are much more chances that trademark infringement exits because a trademark is used in commercial transaction. Even though the U.S. Lanham Act provides fair use exception of trademark dilution, U. S. courts do not have consistent positions about re 1ationship between trademark right and freedom of speech. Korean trademark law does not expressly provide freedom of speech exception, but implies protection of speech restricting the scope of trademark right. However, Korean courts are comparatively skeptical of using free speech to limit trademark right. In modem society, subjects of trademark are varied and the scope of protection is enlarged beyond its rationale of protection. With this trend, there is Possibility that freedom of speech by the public is neglected to protect trademark. Thus, in amending and applying trademark law, it is necessary to try balancing private trademark right and public free speech right.
