It was not a simple problem between Korea and Japan that the neutrality declared by the Korean Empire on the eve of the Russo-Japanese war was abolished by Japan. The Korean Empire, as a sovereign state, became a neutral state in international law by declaring it. However, Japan did not respect the neutrality of Korea on the actual battlefield, and the US also did not question the actions of Japan. As a result, Japan"s violation of the neutrality of Korean Empire during the Russo-Japanese war seriously undermined the rule of law and the law-abiding spirit that had been sustaining western civilization, and thus created a common problem of humanity over sanctions on the war criminals who violated international law.
Japan, as a late imperial power, preferred war rather than an arbitration trial that favors the western powers which were the international establishment. It was the Japanese militarism which got attention from the United States government which envisioned a "containment" strategy to stop Russia"s Pacific policy. From the viewpoint of President Theodore Roosevelt, the Japanese belligerence was useful to keep in Russia in check, it was an extension of the "containment" strategy such the post-war plan of Theodore Roosevelt that Japan occupies the port of Arthur and Korean Peninsula. But this was short-sighted. Japan would not be governed by the international law for it had experienced victory in violation of it. As a result, after the Russo-Japanese War, a long-term task came up for righteous countries of global community to protect the rule of law. Therefore, it seems to be valuable to contemplate the Neutrality of the Korean Empire in which it formed a consensus to establish the collective security system for the sanction of war criminals.
