The agricultural co-operative law has up until today been amended 17 times affecting the typical features of the co-operative enterprise. The amendment of 2004 also provides incentives for the improved companization (capitalization) of the agricultural co-operative. This is not ill equipped enterprise, wrongly construed for the battle with investor-driven enterprises (Public Limited Companies : PLC) on highly competitive markets. Co-operatives differ from commercial, investor-driven enterprises by their objective of serving or promoting their members, who are at the same time their owners and the users of their services. All amendments to the agricultural co-operative law have shown that the particular legal form of the registered co-operative is under constant adaptional pressure and has difficulty preserving its unique co-operative identity. If co-operatives turn into PLC, they cease to be co-operatives. For co-operative legislation this means that the existing laws and regulations have to be revised and excessive government powers to control the agricultural co-operative have to be deleted.
