With the legislation of the special law on ?imunsa truth finding on October 2000, the presidential commission for ?imunsa truth finding was established. Considering the history of kwag? - ch'?ngsan (transitional justice) in Korea, this is a very unprecedented move. In order to explain this situation, it is important to understand the developmental processes of the concept of ?imun - sa and of the movement to uncover suspicious deaths. The purpose of this article is to illuminate the role and problems facing the movement to uncover mysterious deaths by examining its genesis and developmental process.
The term ?imunsa was used to explain a form of human rights violations committed under the military dictatorship and to uncover truths by the truth finding movement.
As the transition to democracy in Korea failed to break completely with the old regime, it was inevitable for the truth finding of ?imunsa, a form of human rights violations committed under the old regime, to face great difficulties. In spite of such difficult conditions, however, the truth finding movement was able to partly overcome the structural limitations and realize the ?imunsa truth findings at a governmental level, although they were limited. By successfully highlighting the national need for ?imunsa truth finding through a strong and organized struggle and the mobilization of civil and political society, the truth finding movement was able to make the Kim Dae-jung government accommodate the restoration of honor of those involved in the ?imunsa truth finding and democratization movements.
These accomplishments of the truth finding movement speak to the importance of the role of social movements in realizing past cleansing as well as establishing its direction, sphere of influence, and process.
However, in the process of special law reform, commission formation, and commission selection, the truth finding movement experienced deep internal rifts that resulted in the secession of a portion of movement activists. Furthermore, due to its failure to mobilize various activist forces within civil society, the truth finding movement has evolved into only victims’ families and a handful of organizations. These rifts and capacity reduction in the truth finding movement meant insufficient effectiveness in curbing the resistance of repressive state organs.
The outcome of truth finding efforts will depend on the degree to which the truth finding movement can effectively deal with these tasks.
