France created the Resale Right in 1920. Resale Right is a artists’ right to share the profits from secondary sales of their works. By 2020, more than 90 countries in the world have introduced the Resale Right. It has widely adopted in most EU countries already. However, there are some differences in the content of the Resale Right of each EU member state. The purpose of this paper is to discuss the influence of the EU’s Resale Right Directive on the development of the Resale Right system by studying the changes of the Resale Right system in France and Germany before and after the promulgation of the directive. This paper first introduces the contents of the EU’s Resale Right Directive, and the contents of the Resale Right system in France and Germany before the promulgation of the directive. After that, this paper sorts out the changes made by these two countries to the relevant provisions of the Resale Right after the directive was promulgated. Finally, this paper points out the conclusion that the EU’s Resale Right Directive unifies the Resale Right system in EU, promotes the legislation of the Resale Right all over the world, and accelerates the process of the right becoming a global right.
