The purpose of this study is about the limitation of the liability and responsibility of travel agency through the case study. To accomplished the main purpose of this study, I researched the related theories of the travel product contracting and the cases of customer complain.
In the case study, the default of the travel agency is studied in the term of 4 categories of impossibility of performance, delay of the performance, incomplete performance, expanded damage.
This study found that the regulation defining the liability of travel agency at the default is not provided in our legal circumstance. Therefore, the registration of the reluctant regulation is promptly required
In the near future the demand of the outbound travel will be expected to increase and this will be accompanied with more customer complains. Therefore, the provision of the regulation for the travel product contracting is in need at present moment to protect the travelers, identifying the responsibility of travel agency in the case of the default regarding all commercial travel activities.
