This article analyzed the recent trend of studies in Japanese education law and current issues. The current issues were selected from the comprehensive analysis on the topics of the National Conferences of the Japan Education Law Association from 11st(1981 Year) to 36th(2006 Year), and the whole articles published during these years in the 「Education Law Review」 and 「Journal of Seasonal Education Law」.
As the first current issue, this article analyzed the birth of Japan educational legal system from 1945 after second world war to 1980. The legal issue was focused on the change of the educational system comparing to it in the before of 1945 and the change of the idea and goal of Japan education policy.
The second, this article analyzed the brief contents and the main principles of Japan Education Law and Cord, for example “Japan Basic Educational Law” that established in 1980s. The current issues and topics were focused on the Teachers’ educational rights on the Japan constitution and whether their labor rights were constitutional rights or not.
The third, this article covered the issues of the students’ rights to learn and the educational rights of parents on the Japan educational legal system in the 1990s. In these period, student’s rights to learn were recognized as the core issue in the educational rights theory and parents had a movement to argue their rights in the school to school authority and had a parents association(PTA).
The fourth, this article also analyzed the tendency of reform in the field of educational legal system in Japan from 2000 to 2006 and finally, suggested several implications to Korean education policy makers from the four issues of the Japan education law.
