After the successful conclusion of the Korea-Chile Free Trade agreements in 2003, Korea began to negotiate and conclude Free Trade Agreements(FTA) with the U.S., ASEAN, Singapore, EFTA and very recently the EU. It is expected that Korea's volume of trade pursuant to these regional trade agreements will constitute more than 84% of its total trading volume in the next ten years.
In this regard, the preferential rules of origin (ROO) in the FTA are the key issue with respect to eligibility for trade benefits. Without clear description of the FTA/ROO criteria, ROO can be used as discriminatory measures, i.e. non-tariff barriers. Looser ROO criteria encourage trade between the FTA countries by reducing unnecessary transaction costs.
This paper describes the international rules regarding the ROO pursuant to the WTO agreements, World Customs Organization(WCO), and the UN. Furthermore, it presents a variety of transaction techniques for Korean trading companies to leverage these preferential ROO to qualify for preferential treatment.
